Privacy Policy

1. Information We Collect

When you visit Little Diggers Play Space, we may collect the following information from accompanying adults (never directly from children):

• Phone number — provided voluntarily at check-in to receive SMS session-expiration reminders
• Name — to address you in communications and for check-in records
• Email address — if voluntarily provided for service-related updates
• Children's names and dates of birth — collected via our digital liability waiver for safety, session management, and age verification. This information is provided by the accompanying guardian, not by the child directly.

We do not solicit information directly from children under 13. All information about minors — including names and dates of birth — is provided by an accompanying adult guardian via our liability waiver process.

\Website Tracking Technologies (Cookies)

In addition to the information described above, our website uses tracking technologies, including cookies and similar tools, to understand how visitors use our site.

• Types of data collected: page views, timestamps, URLs visited, referring pages, and device/browser information.
• Purpose: this data is used to power personalized marketing campaigns, automated communications, and audience segmentation, and to help us understand and improve how visitors use our website.
• Third parties: we share website analytics data (not SMS phone numbers) with Constant Contact, our email marketing platform, solely to operate our own email marketing campaigns. Constant Contact is contractually prohibited from using this data for any other purpose.
• Managing cookies: most browsers let you block or delete cookies through their settings. Doing so may affect how parts of our website function. Where required by applicable law, we will provide additional cookie consent controls on our site.

2. SMS Notification Program

Little Diggers Play Space operates an SMS notification program for the sole purpose of alerting guardians when their child's play session is nearing its end.

• Program description: We send automated SMS text messages to notify you when your play session is expiring, typically 10 minutes before the session ends.
• Message frequency: Message frequency varies. You will typically receive no more than 1–2 messages per visit.
• Rates: Message and data rates may apply. Check with your mobile carrier for details.
• To stop receiving messages: Reply STOP to any message at any time. You will receive one confirmation and no further messages will be sent.
• To re-enable messages: Reply START to the same number.

Providing your phone number is entirely voluntary and is not a requirement for entry or use of our facility.

3. How We Use Your Information

• Sending SMS alerts when your play session is nearing expiration
• Communicating operational updates about our facility

• Complying with legal obligations

We do not use your phone number to send marketing or promotional messages without your separate, explicit consent.

4. Information Sharing and Disclosure

We do not share your mobile phone number or messaging consent with any third parties or affiliates for their own marketing or promotional purposes.

We share information only in the following limited circumstances:

• SMS delivery providers (such as Twilio) — solely to deliver the text messages you've consented to receive. These providers are bound by their own privacy policies and are prohibited from using your data for any other purpose.
• Our marketing platform (Constant Contact) — if you separately opt in to our marketing list (e.g., via our website newsletter signup), your contact information is stored in this platform. Constant Contact acts only as our service provider: it does not use your information for its own purposes, and phone numbers stored in this platform are never used to send text messages. Marketing communications are sent by us, only to contacts who opted in separately, and are never sent to the number you provided at check-in for session-reminder texts unless you separately opted in to marketing using that same number.
• Legal compliance — when required by law, court order, or to protect the safety of our guests and staff.

5. Data Retention

We retain personal information for as long as reasonably necessary to provide our services or as required by applicable law. You may request correction or deletion of your information at any time by contacting us at contact@littlediggersplayspace.com. Opting out of SMS by replying STOP will remove your number from our messaging list immediately.

6. Data Security

We implement reasonable technical and organizational measures to protect your personal information. No method of electronic storage or transmission is 100% secure, but we take your privacy seriously.

7. Children's Privacy

We do not knowingly collect personal information directly from children under the age of 13. All data we collect is provided by accompanying adults or guardians.

8. Your Rights

Terms of Use

1. Facility Rules

All guests must follow posted facility rules and staff instructions at all times. Little Diggers Play Space reserves the right to refuse entry or ask guests to leave for non-compliance, disruptive behavior, or safety concerns.

2. SMS Notification Consent & Opt-In

By providing your mobile phone number at check-in, you expressly consent to receive automated SMS text messages from Little Diggers Play Space to the number provided. The messages you will receive are session-expiration reminders notifying you that your play session is nearing its end.

Consent to receive SMS messages is not a condition of entry, purchase, or use of our facility. You may visit and enjoy Little Diggers Play Space without providing a phone number.

• To stop messages: Reply STOP to any message. You will receive one final confirmation, then no further messages.
• To resume messages: Reply START.
• For assistance: Reply HELP or email contact@littlediggersplayspace.com.
• Message frequency: Typically 1–2 messages per visit. Message and data rates may apply.

Little Diggers Play Space will not use your phone number for marketing or promotional purposes, and will not share it with any third parties or affiliates for their marketing or promotional purposes, without your separate, explicit consent.

3. Assumption of Risk

Play space activities involve inherent physical risk. By entering the facility, guests and accompanying guardians acknowledge and accept these risks. Little Diggers Play Space is not liable for injuries resulting from normal use of the facility, provided that safety rules and staff instructions are followed.

4. Limitation of Liability

To the fullest extent permitted by law, Little Diggers Play Space shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the facility or our services, including SMS notifications.

5. Acceptable Use

Guests agree not to engage in unsafe or disruptive behavior, violate any applicable law while on the premises, or provide false contact information.

6. Changes to These Terms

We may revise these Terms of Use at any time. Continued use of our facility or services constitutes acceptance of any updated terms.
